Rules and regulations of the online system e-statek.pl - Online cruise reservation system



  I. General information

1. The online trip booking system available at www.e-statek.pl is operated by the company Krakowska Grupa AMNIS Spółka z ograniczoną odpowiedzialnością registered at the District Court for the city of Kraków, Commercial Division of the National Court Register, KRS 0000584827, NIP 6793118282, REGON 362949560, which conducts business activity on the basis of an entry to the Central Registry and Information on Business Activities (CEIDG) of the Republic of Poland. To check the current status of the entry, search for the entry in the CEIDG system (www.firma.gov.pl).

5. The online trip booking system’s script uses cookies. Details about these are provided in the Legal Notice tab which constitute an integral part of these Terms and Conditions.

 

II. The offer in the booking system

1. The offer available in the online trip booking system e-statek.pl – Online Trip Booking System is not a commercial offer within the meaning of the Civil Code, and solely constitutes an invitation for purchase offers.

2. Only a legal or a natural person who holds a full or limited capacity for legal transactions may be a customer of the system.

3. When placing an order through the system, the Customer confirms that they are familiar with the content of the Terms and Conditions by ticking the option “I accept the terms of use of the online system”, thus accepting the provisions contained therein.

4. Each customer may create only one account in the online trip booking system associated with one email address. The online trip booking system does not allow the creation of several accounts for the personal data of one and the same customer.

5. The purchase and sale agreement is concluded when the online trip booking system’s staff confirm acceptance of the purchase offer for realisation. The purchase and sale agreement is concluded between the Buyer and the company Krakowska Żegluga Pasażerska. The concluded agreement is fixed by printing it and providing it to the Customer at the collection of the ticket(s), receipt or VAT invoice. The agreement for the purchase and sale of goods is concluded under the laws of Poland and in the Polish language.

6. The prices for all the goods in the online trip booking system are provided in PLN and include VAT.

7. The online trip booking system does not send tickets for trips.  



III. Placing an order and its execution

1. Purchase offers may be submitted electronically via the website of the online trip booking system at: www.e-statek.pl, by email at: rezerwacje@e-statek.pl and also by telephone at: +48 505 102 677 from 10 a.m. to 6 p.m. CET, every day except Saturdays, Sundays and holidays. The Customer’s offer to conclude the purchase agreement constitutes their order.

2. For the execution of the order it is necessary to provide the telephone number and email address in the personal form - after the purchase offer is received, the online trip booking system’s staff may verify it by telephone and/or by email. Mandatory fields in the form are marked with an asterisk. The seller bears no liability if the Customer provides incomplete or incorrect contact details. If the form is completed incorrectly, the order cannot be executed. After the purchase offer is received, an email notification is sent to the customer to that effect.

3. The customer adds their selected tickets to the shopping cart with the ADD TO CART button located near each product. Then the customer follows the instructions in the Shopping Cart tab until they reach the stage of their order confirmation.

4. The customer may change the purchase offer or cancel it entirely until the online trip booking system’s staff confirm acceptance of the order for execution. Any changes to the purchase offer or the decision to cancel it should be communicated electronically at by email at: rezerwacje@e-statek.pl or by telephone at +48 531 983 730 or 505 102 677 (from 10 a.m. to 6 p.m., every day except Saturdays, Sundays and holidays).

5. Orders are executed at the time of personal collection of tickets, after prior conclusion of the purchase and sale agreement.

6. The ticket cannot be ordered for the day when the order is placed.  

7. The ticket(s) may be ordered well in advance but only for the current calendar year.

8. The current schedule of trips is always available at www.StatekKrakow.com

 

IV. Prices and payments

1. The online trip booking system e-statek.pl reserves the right to change the offered ticket prices due to increases in the price of fuel and fleet operation, introduction of new tickets to its offer, introduction and cancellation of promotional and marketing actions on the pages of the system or introduction of changes to these.

2. The provision in section 1 does not apply to orders accepted for execution - i.e. those for which the purchase and sale agreement has already been concluded.

3. A booking requires conclusion of the sale and purchase agreement by paying the full amount for the ticket(s) at the time of their purchase.  

4. The customer may only pay for the ordered tickets by the forms of payment available in the system. They may choose the following from among them:
- by the system of the external payment service provider Przelewy24.pl. The order will be confirmed and can be executed in the indicated time after the provider confirms receipt of the funds for the order
- from a PayPal account; the required amount is collected at the time of order (purchase offer). If the online trip booking system is unable to accept the purchase offer in whole (or in part) or if the customer withdraws from the placed purchase offer (before the system accepts it), the online trip booking system will refund the payment (or its part) to the customer’s PayPal account. The customer may not submit any claims regarding interest on the refunded amount.

5. Payment by an ordinary bank transfer or at the time of delivery is not possible.

6. A transaction which is not paid for at the time of placing the order will be automatically cancelled within 24 hours. It is not possible to return to such a transaction.

7. An order may be changed only until it is confirmed as accepted for execution. After signing out of the system and after receiving a confirmation of acceptance of the order for execution from the system’s staff, and after signing in again, for technical reasons it is not possible to increase or decrease the number of the purchased tickets by editing the order again. If additional tickets are needed, please make a new transaction.

8. An invoice is issued at the request of the customer, at Przystań Wawel in Kraków, address: ul. Bulwar Czerwieński 3, on the basis of a presented receipt.

9. If the trip(s) is/are cancelled, it is possible for the company Przedsiębiorstwo Prywatne Marek Morawiec to withdraw from the concluded purchase and sale agreement in the situations envisaged by the law. In this case, the customer will receive a refund of the whole amount paid for the booked tickets. V. Personal collection

1. In the case of tickets ordered for trips via the online trip booking system, personal collection is possible only on the day of the booked trip for which the ticket was ordered, at Przystań Wawel in Kraków, address: ul. Bulwar Czerwieński 3, every day from 10 a.m. to 8 p.m., only after payment for the tickets ordered.
2. Tickets must be collected not later than 10 minutes before the beginning of the trip.  
3. Tickets are collected on the basis of the identity card of the person who placed the order or on the basis of the order number provided. The user bears full responsibility for providing the order number to third parties.
4. Personal collection is not subject to any additional charges.
5. Shipment of tickets is not possible.

VI. Withdrawal from the agreement in the case of conclusion of a distance agreement

1. Under the Act of 30 May 2014, the customer may withdraw from the agreement for the purchase of the ticket in the online trip booking system e-statek.pl without stating the reason within 14 days from the date of collection of the ticket. This is only possible if the ticket has not been used or destroyed in any way.
The template form for withdrawal from the product agreement is attached to each order.

2. The ticket may be returned within 14 days from the date of purchase. The online trip booking system guarantees a refund for the price of the ticket.

3. The payment will be refunded as soon as possible, not later than within 14 business days, by transfer to the bank account indicated by the customer. In the event of a card payment, the refund will be made to the card used for the payment.


VII. Claim handling procedure

1. The claim will be considered within 14 (fourteen) business days from the date of its receipt, in writing, at the company address indicated in part I section 2 or electronically at rezerwacje@e-statek.pl.  
2. The customer may submit a complaint within 2 months from the occurrence of the event which provided the basis for the claim.  
3. The claim should include the name, surname, full address of the customer and a detailed description of the basis for the claim.
4. The customer will be informed about the decision of the online trip booking system by way of a reply in writing or electronically sent within 7 (seven) business days from the date of the decision regarding the claim.


VIII. Personal data

1. Under the Act of 29 August 1997 on the protection of personal data, the Seller informs that personal data of all customers are stored in the database of the online trip booking system e-statek.pl – Online Trip Booking System. The data controller is the company Krakowska Żegluga Pasażerska, 31-752 Kraków, ul. K. Makuszyńskiego 26. Personal data are gathered solely for the purposes of execution of the orders by the online trip booking system. They are processed in accordance with the requirements of data security specified in the Act on the protection of personal data. Each customer has the right to access their data, to rectify them, to request the data processing to be discontinued, and the right to object. Any objections should be expressed in writing and submitted to the address of the company’s headquarters.

2. The company Krakowska Żegluga Pasażerska will bear no liability for any losses incurred if the customer provides third parties with the login and password allowing them to sign into the online trip booking system.

3. The company Krakowska Żegluga Pasażerska undertakes to carefully store and safeguard personal data and not to disclose such data to third parties without the customer’s consent.


IX. Final provisions

1. The online trip booking system will make every effort to resolve any disputes amicably and in favour of the customer.
2. If an agreement cannot be reached, the disputes will be resolved before courts in accordance with the Code of Civil Procedure.

3. Photos and information provided on the website of the system constitute the property of the company Krakowska Żegluga Pasażerska and may not be used by other persons and/or entities without the consent of the Seller.

4. These Terms and Conditions enter into force on 23 February 2015. Any Amendments to these Terms and Conditions will be published on the Terms and Conditions page of the online trip booking system  www.e-statek.pl

5. Any amendments to the Terms and Conditions do not apply to orders already accepted for execution – such orders are subject to the terms and conditions valid at the time of the purchase offer.
